Please read these terms carefully before booking or using the Smart Studio platform.

1. Acceptance of Terms

By accessing or using the Smart Studio website (www.mysmartstudios.com), the booking portal (portal.mysmartstudios.com), or any related mobile application (collectively, the "Platform"), or by making a booking or using any services, you ("Guest", "User", or "You") agree to be bound by these Terms and Conditions ("Terms") and our Privacy Policy.

These Terms constitute a legally binding agreement between you and Weffex Solutions Private Limited("Company", "We", "Us"). If you do not agree with any part of these Terms, you must not use the Platform or our services. By proceeding with a booking, you confirm that you are at least 18 years of age and legally capable of entering into contracts under the Indian Contract Act, 1872.

2. Description of Services

Smart Studio, operated by Weffex Solutions Private Limited, provides:

  • Short-term and long-term accommodation in fully furnished studio rooms, deluxe studios, service apartments, and office suites located at Gaur City Center, Greater Noida West, Gautam Buddha Nagar, Uttar Pradesh
  • An online platform enabling guests to search, view, and book accommodation
  • Ancillary services including food and pantry ordering, laundry, housekeeping, maintenance management, transport booking, visitor passes, and parcel tracking through the resident portal
  • Smart keyless IoT-based room access via digitally generated access codes
  • A loyalty rewards programme (Smart Rewards)

3. Booking and Reservation

3.1 Making a Booking

  • Bookings are made through the Platform by selecting your desired room type, check-in date, check-out date, and number of guests
  • A booking is confirmed only upon successful payment and issuance of a booking confirmation number via email and WhatsApp
  • Prices displayed are in Indian Rupees (INR) and include applicable GST unless otherwise stated
  • Availability is displayed in real-time but is not guaranteed until payment is completed

3.2 Guest Eligibility

  • The primary booker must be at least 18 years of age
  • All guests (including accompanying persons) must present valid government-issued photo ID (Aadhaar, PAN, passport, or driving licence) at check-in or via eKYC prior to arrival
  • We are required by law to maintain a guest register and submit police intimation (Form C) for all guests, including foreign nationals
  • We reserve the right to refuse check-in if valid ID is not produced

3.3 Occupancy Limits

Rooms must not be occupied by more guests than the stated maximum occupancy. Violation may result in immediate termination of the booking without refund and removal from the premises.

4. Pricing and Payment

4.1 Pricing

  • Prices are per room per night (or per day/month as applicable) and are inclusive of GST at the applicable rate
  • Prices include: WiFi, electricity, water, daily housekeeping, and 24/7 security
  • Prices do not include: food and pantry orders, laundry, transport, or other ancillary services unless explicitly stated in the booking
  • We reserve the right to modify prices at any time; modifications will not affect confirmed bookings

4.2 Payment

  • Payment is due in full at the time of booking via the secure payment gateway (Razorpay / PayU)
  • Accepted payment methods: UPI, credit/debit cards (Visa, Mastercard, RuPay, Amex), net banking, and digital wallets
  • All payments are processed over secure, PCI DSS-certified infrastructure. We do not store card details
  • A tax invoice (GST Invoice) will be issued upon completion of your stay or upon request
  • For extended stays (30+ nights), payment may be structured as monthly in advance at our discretion

4.3 GST

GST is applicable on accommodation services as per the prevailing GST tariff for the applicable room category. The GST Invoice will include our GSTIN: 09AADCW0000A1Z5.

5. Check-In and Check-Out

  • Standard Check-In Time: 12:00 PM (noon) IST
  • Standard Check-Out Time: 11:00 AM IST
  • Early check-in (before 12:00 PM) and late check-out (after 11:00 AM) are subject to availability and may attract additional charges
  • Check-in is facilitated via a smart digital access code delivered to your registered mobile number and email. No physical key is issued
  • In case of technical failure of the access system, our 24/7 support team will assist immediately
  • Check-out requires vacating the room and logging out of in-room services by the check-out time. Late departure may attract a charge equivalent to one additional night

6. Guest Conduct and House Rules

By completing a booking, you agree to comply with the following house rules:

  • No parties or loud gatherings that disturb other residents — quiet hours are 10:00 PM to 7:00 AM
  • No smoking inside rooms or common areas; designated smoking zones are available
  • No illegal substances on the premises — violation will result in immediate eviction and a police report
  • No unauthorised guests in rooms beyond the booked occupancy without prior approval and issuance of a guest pass
  • Guests are responsible for any damage to room furniture, fixtures, equipment, or property beyond normal wear. Damage costs will be charged to the payment instrument on file
  • Pets are not permitted unless written permission is obtained in advance
  • Firearms, weapons, or hazardous materials are strictly prohibited
  • Any activity that is illegal under Indian law is prohibited and will be reported to authorities
  • Guests must comply with all fire safety protocols and evacuation procedures

7. Cancellation and Refund

Please refer to our separate Refund & Cancellation Policy for complete details. In summary:

  • Cancellation 48 hours or more before check-in: Full refund
  • Cancellation within 48 hours of check-in: 50% refund
  • No-show: No refund
  • Refunds are processed within 5–7 business days to the original payment method

8. Ancillary Services

  • Food, laundry, transport, and other ancillary services are provided by third-party vendors and the Company acts as a facilitator
  • Additional service charges will be billed separately and are payable immediately upon consumption
  • Ancillary service orders are non-cancellable once prepared or dispatched
  • The Company is not liable for delays or quality issues with third-party vendor services but will assist in resolving complaints

9. Loyalty Programme

  • Smart Rewards points are earned on eligible bookings and service spend at the rate notified on the Platform from time to time
  • Points have no cash value and are non-transferable, non-saleable, and expire 12 months from the last booking activity
  • Tier benefits (Bronze, Silver, Gold, Platinum) are subject to the terms published on the Platform
  • The Company reserves the right to modify, suspend, or terminate the loyalty programme with 30 days' notice

10. Intellectual Property

All content on the Platform — including text, graphics, logos, images, software, user interface, and technology — is the exclusive property of Weffex Solutions Private Limited or its licensors and is protected by Indian and international intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our prior written consent.

11. Disclaimers and Limitation of Liability

  • Accommodation is provided on an "as is" basis. We do not warrant uninterrupted service, freedom from defects, or that the Platform will be error-free
  • We are not liable for any indirect, incidental, consequential, or punitive damages arising from your use of our services
  • Our total liability to you for any claim arising from a booking shall not exceed the total booking amount paid for the specific booking in dispute
  • We are not responsible for loss, theft, or damage to your personal belongings on the premises. Guests are advised to use in-room safes where available
  • Force majeure: We shall not be liable for failure to perform our obligations due to events beyond our reasonable control, including natural disasters, pandemics, government actions, or power failures

12. Indemnification

You agree to indemnify, defend, and hold harmless Weffex Solutions Private Limited and its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising from your breach of these Terms, violation of any law, or infringement of any third-party rights.

13. Governing Law and Dispute Resolution

  • These Terms are governed by and construed in accordance with the laws of India
  • In the event of any dispute, both parties shall first attempt to resolve the matter amicably within 30 days of written notice
  • If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts of Gautam Buddha Nagar (Greater Noida), Uttar Pradesh
  • Consumer disputes may be referred to the appropriate Consumer Disputes Redressal Forum under the Consumer Protection Act, 2019

14. Consumer Rights

As a consumer, you are protected under the Consumer Protection Act, 2019 and the Consumer Protection (E-Commerce) Rules, 2020. If you have a complaint, you may contact our Grievance Officer (details below) or approach the National Consumer Helpline (NCH) at 1800-11-4000 or the consumer court having jurisdiction.

15. Modifications to Terms

We reserve the right to amend these Terms at any time. Material changes will be notified via email and a prominent Platform notice at least 15 days before the changes take effect. Your continued use of the Platform after the effective date constitutes acceptance. If you do not agree to the revised Terms, you must discontinue use of the Platform.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
